Terms and Conditions 

📄 Fierce Photography Terms & Conditions

Revised: July 2025

1. Booking & Acceptance

  • Your booking is confirmed once a non-refundable deposit is paid.

  • Payment of the deposit constitutes acceptance of these Terms & Conditions and creates a legally binding contract.

  • We may update these Terms with reasonable notice; continued use after such notice implies your acceptance.

2. Governing Law & Dispute Resolution

  • This contract is governed by English law and any disputes will be resolved in the courts of England and Wales.

  • If there’s a dispute, we will first seek mediation before resorting to litigation.

3. Booking Date, Rescheduling & Cancellations

  • Deposits are non-refundable but are transferable if you provide at least 7 days’ notice to reschedule.

  • Rescheduling within 7 days may incur a £49 adjustment fee.

  • Cancellations with less than 7 days’ notice may result in the deposit being lost.

  • If we need to cancel or reschedule, we’ll aim to offer an alternative date or issue a refund.

4. Pricing, Payment & Cooling-Off Rights

  • All prices are in GBP (£), as agreed at booking.

  • Deposit secures your booking; full balance is due before images are released.

  • Payment methods: Bank Transfer, Card via PayPal or website, or cash in-studio.

  • Payment plans: Available at the studio’s discretion. Images are released only after final payment.

  • Under UK law, booking of photography services means you do not have a 14-day cooling-off period once the service has begun or the shoot date has passed.

5. Loyalty Scheme

  • Free to join; earn 250 points per photoshoot booking.

  • Points equate to rewards (e.g. £1 credit per 10 points). Non-transferrable and no cash value.

6. Health & Safety

  • Inform us of infectious illnesses, allergies, or medical conditions before your session.

  • If ill with a contagious condition, reschedule once fully recovered to protect staff and clients.

7. Session Timing & Conduct

  • Arrive promptly; sessions shortened if more than 15 minutes late.

  • More than 30 minutes late without notice may result in cancellation with no refund.

8. Photographer’s Creative Control

  • Photographer decides on creative aspects—lighting, location, poses, style.

  • You give the photographer full creative and editorial rights on images.

9. Image Selection & Retouching

  • Photographer’s choice of final images is final.

  • Additional editing or special requests may incur extra charges and delay delivery.

10. Image Delivery, Fulfilment & Archiving

  • All orders are final and non-refundable, due to the custom nature of our work.

  • Offer discounts only during the initial ordering window.

  • Typical delivery is 3–6 weeks after full payment.

  • Images are archived for 8 weeks after delivery, after which they may be deleted. Clients must backup digital files themselves.

11. Intellectual Property & Usage Rights

  • All copyright belongs to Fierce Photography under the Copyright, Designs and Patents Act 1988.

  • You may share images online only after purchasing them.

  • No copying, screenshotting, or modifying unreleased images.

12. Data Protection & GDPR

  • We comply with UK GDPR and the Data Protection Act 2018.

  • We process your data only as described in our Privacy Policy.

  • Images will not be used publicly without your explicit permission.

13. Liability

  • Our liability for any loss or damage is limited to the total fees paid.

  • We do not accept liability for indirect or consequential losses.

  • If technical failure or other issues affect your shoot, your sole remedy is a refund of fees if we cannot reschedule.

  • We are not responsible for personal injuries; clients follow our instructions at their own risk.

  • We hold Public Liability Insurance.

14. Contingency – Photographer Incapacity

  • If the photographer becomes unavailable due to unexpected illness, we will either:

    • Offer a suitable replacement, or

    • Refund your fees if no replacement is agreed.

15. Complaints

  • Please send complaints to: studio@fiercephotography.co.uk.

  • We aim to acknowledge receipt within 5 business days and respond with a resolution within 14 days.nn within 14 days.
