Terms and Conditions
This page details the current terms and conditions for Fierce Photography. When you are ready to
book a date for your photoshoot, you will receive a link to this page via email. We ask you to
carefully review the information below and seek any clarification from us prior to making a booking.
Placing your deposit to secure a shoot date, unless expressed otherwise, is your acceptance of our
Terms and Conditions.
We reserve the right to change these Terms & Conditions at any time and will give reasonable notice
to you if this happens.
GENERAL
These Terms and Conditions constitute an agreement between the parties and supersede all
previous agreements between the parties relating to its subject matter. No variation or agreed
termination of these terms and conditions (or of any document referred to in it) shall be effective
unless it is in writing. If any provision of this agreement (or part of any provision) is found by any
court or other authority of competent jurisdiction to be invalid, unenforceable, or illegal, the other
provisions shall remain in force. A person who is not a party to this agreement shall not have any
rights under or in connection with it.
This agreement and any dispute or claim arising out of or in connection with it or its subject matter
shall be governed by and construed in accordance with the law of England and Wales.
ACCEPTANCE
Your booking and/or payment of your deposit signifies acceptance of these terms and conditions as
a legally binding contract, unless otherwise objected to explicitly and in writing, prior to accepting
our service. No variation of this contract shall be recognised unless explicitly agreed to in writing.
Any booking or payment made to Fierce Photography (including the deposit) indicates that you have
read, understood, and agreed to all the terms and conditions as set out in this document, in its
entirety. If this contract must be enforced, you agree to mediation instead of court proceedings.
RESERVATIONS
Your photoshoot session is reserved only once the deposit amount is paid for. Deposits are non-
refundable and contribute towards the photographer’s time planning your shoot with you and
associated studio running and staffing costs.
RESCHEDULING & REFUNDS/CANCELLATIONS
We completely understand that sometimes it is necessary for the photographer or client to
reschedule, for example due to injury or serious illness. If there are unavoidable circumstances that
affect your ability to take part in our photo shoot session, then we are happy to move your shoot
date without charge as long as 7 days’ notice is given. Cancellation with less than 7 days’ notice may
incur a moving fee of £49 to secure a new date. Please note that any new date will be subject to the
Photographer’s availability, however we will always try and work with you to find a mutually
agreeable date. If we cannot agree another date, or if you are unable to attend your re-booked
session, then your deposit will be lost. Your deposit is non-refundable should you decide to cancel
your photoshoot or not attend on the day.
Please note that all Gift Vouchers and Gift Certificates are non-refundable and have no cash value.
PRICES & PAYMENTS
The price for your photo shoot session will be as agreed at the time of booking. All prices are in
sterling (£).
All photoshoot sessions must be taken within 12 months of the deposit payment being made. Any
exceptions to this need to be agreed in writing, and the current prices and booking conditions will
apply.
The balance is to be paid in full before images are released to you. Payment can be made by Bank
Transfer, Card Payment via PayPal/Fierce Website, or via cash in person at the studio.
Payment plans for images are offered at the discretion of the Studio Manager.
Where payment plans are agreed the client agrees to make payment in full on the dates agreed. You
will not receive any images until final payment is made.
Once placing your order which is to be paid for on a payment plan, this is a binding contract, and you
commit to completing the full payment. There shall be no refunds at any stage due to the custom
nature of our work.
LOYALTY SCHEME
The Loyalty Scheme is free to join (no purchase required). Members can earn points every time they book a photoshoot with us. For every 10 points you earn, you will build up a £ in your pot. Each new booking will generate 250 points. Points can redeemed against the cost of a full price photoshoot, or to pay for extra images and upgrades. Points have no cash back value and cannot be applied to other discounts or offers.
HEALTH
If you are taken ill by an infectious disease, you must let us know and rearrange your session until
you are fully recovered and no longer contagious. This is to protect the health of our clients and
staff.
Please inform us on booking if you or anyone attending your photography session suffers from any
health conditions including allergies, photosensitive epilepsy, medical issues, physical difficulties so
we can make necessary adjustments.
COPYRIGHT & OWNERSHIP
The copyright and all other rights in the photos shall be retained by Fierce Photography. The
Photographer asserts the right to be credited as the author of the photos in accordance with
sections 77 and 78 of Copyright, Designs and Patents Act 1988. Any unauthorised reproduction or
modification of any images will constitute a breach of copyright. This includes making copies or
‘screen shots’ of images shared by the photographer online.
Sometimes the photographer may share previews of your images, or give you access to an online
gallery of images. These images must not be copied, screen shot, downloaded, edited, or altered in
any way.
If you wish to share photographs to your own network (i.e. Facebook, blog or any other online
channels) you agree to do so only once you have purchased and paid for them.
OUR OBLIGATIONS
We will use reasonable endeavours to supply the Photography Services described on our website
and marketing materials in a professional manner.
YOUR OBLIGATIONS
On making a booking with Fierce Photography you agree that you have looked at the photographs
within our website and are happy with the photographer’s ‘style’, if you are looking for a different
‘style’ of photograph – this must be discussed before making your booking.
SESSION TIMES & DURATION
Please make every effort to arrive on time for your session and please let us know as soon as
possible if you anticipate arriving late. If you are more than fifteen minutes late, your session length
may be reduced accordingly. If you are more than 30 minutes late, your session may be cancelled,
with no refund or re-shoot provided.
If a session duration is not specified as part of your package, we will end the session at our discretion
when we determine that adequate images in terms of quality and quantity have been captured.
CREATIVE LICENCE
You grant the photographer full creative licence to shoot, select images, edit images, and deliver
them in the style and method chosen by the photographer and reflective of the style and quality
advertised by the photographer.
SHORTLISTING & EDITING
Your photographer will carry out any shortlisting and editing necessary to prepare your images for
release to you.
The photographer’s judgement in all matters regarding locations, composition, poses, number of
photographs taken, and all such like matters shall be deemed to be correct.
The photographer’s choice of image selection is final. Additional editing can be requested but is
delivered at the photographer’s discretion and may incur additional charges and wait times.
IMAGE EDITING
Image editing includes full retouching of skin. Please refer to our online portfolio for examples of our
editing style. If you have specific editing requirements, please ensure that you have communicated
these with us during your pre shoot consultation so we can discuss any limitations.
The photographer holds the right to charge additional fees for any additional editing or special
requests by the client – any such requests will be accepted or declined on the discretion of the
photographer and whether it is fitting with her style or techniques. Additional editing work may
extend the timeline for your images to be delivered to you.
ORDER SALES & FULFILMENT
Due to the nature of custom photography, all orders are final and cannot be cancelled or refunded.
Please note that any special offers and discounts only apply to your initial ordering window.
Delivery times for images may vary and will be advised at the time of ordering but is usually within 3-
6 weeks.
IMAGE ARCHIVING
Fierce Photography will keep all images on archive for 8 weeks from the date they are released to
you, after which they may be permanently deleted.
It is your responsibility to backup any digital files you receive. We recommend that you create
multiple backups on different devices.
DATA PROTECTION
Fierce Photography will store Client names, contact details and session information privately and will
not share these with any other business or organisation. A separate Privacy Policy is available HERE.
LIABILITY
In the unlikely event of technical problems, camera/photographic failure, loss of image(s) before
delivery to the client is made, injury or sickness beyond my control, our liability shall be limited to a
full refund of all monies paid.
We will not be liable for any acts, events, omissions, or accidents beyond our reasonable control,
including strikes, failure of a utility service or transport network, act of God, war, riot, civil
commotion, malicious damage, compliance with any law or governmental order, rule, regulation or
direction, accident, breakdown of plant or machinery, inclement weather or default of suppliers or
sub-contractors.
The limitation on liability shall also apply if photos are lost through equipment malfunction or
otherwise lost or damaged. Our total liability for any breach, representation, act, or omission
(including negligence) shall be limited to our fee in relation to the Photo Services and we shall not be
responsible for any special, indirect or consequential or pure economic loss, costs, damages, charges
or expenses.
In the event of incapacitating illness or injury to the Photographer, we will have the option,
whenever possible, to mutually agree with you a replacement photographer to carry out the Photo
Services. If we cannot agree a replacement, then we shall refund to you any fee paid in relation to
the interrupted Photo Services in full.
Any directions issued to clients, their guests or employees during a photographic shoot/event are
deemed to be at said person’s own risk. Fierce Photography cannot be held responsible for any
personal accidents during a photographic shoot.
Fierce Photography holds Public Liability Insurance.
IMAGE PERMISSIONS RELEASE
Being able to share the photographs we capture is an essential part of running a photography
business – after all, seeing our work is usually one of the main reasons clients book us!
Nevertheless, the General Data Protection Regulation (GDPR) requires that we make clear that your
images will never be published in any form without your express consent.
COMPLAINTS
In the unlikely event that you wish to make a complaint, please do so in writing – Fierce
Photography, Temple House, Greenhough Road, Lichfield WS13 7AU. All complaints will be
investigated and responded to within 14 days of receipt.
